1. Agreement to Terms

By accessing or using Calog ("the Service"), operated by Dynamis Health UG (haftungsbeschränkt), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service & Medical Disclaimer

Calog is an AI-powered calorie tracking application that allows users to log meals using natural language.

3. User Accounts

To use certain features, you must create an account. You are responsible for safeguarding your credentials. You must be at least 18 years of age or have legal parental consent to use this Service.

4. User Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which explains how we handle your personal information and health-related data in compliance with the GDPR.

5. Subscriptions

calog Premium is offered as auto-renewable subscriptions through the Apple App Store. The following terms apply to all subscriptions purchased through the calog app:

• Title: calog Premium (unlimited Calo chat, evaluations, and meal logs).
• Available plans:
  • Weekly: €1.99 / week
  • Monthly: €4.99 / month
  • Yearly: €29.99 / year, with a 3-day free trial for new subscribers.

  Prices may vary by country; the actual price for your region is displayed on the in-app purchase screen at the moment of purchase.

• Payment is charged to your Apple ID account at confirmation of purchase.
• Subscriptions automatically renew unless auto-renew is turned off at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period, at the same price as the original subscription.
• You can manage and cancel your subscription at any time by going to your Apple ID Account Settings (Settings → [your name] → Subscriptions on your device, or App Store → Account → Subscriptions) after purchase. Cancellation takes effect at the end of the current billing period; you retain access to calog Premium until then. No partial refunds are issued for unused time in the current period.
• Free trial: if you start a free trial and do not cancel at least 24 hours before the end of the trial period, your subscription will automatically convert to a paid subscription at the price stated above. Any unused portion of a free trial is forfeited when you purchase a subscription before the trial ends.
• Refunds for App Store purchases are handled solely by Apple. Refund requests can be submitted at reportaproblem.apple.com.
• These subscription terms are in addition to Apple's standard Apple Media Services Terms and Conditions, which also apply to your purchase.

6. Acceptable Use

You agree not to:

• Use the service for any illegal purposes.
• Attempt to reverse engineer or scrape the Service's AI models.
• Circumvent any security or access controls.

7. Intellectual Property

All content, features, code, and functionality of the Service are owned by Dynamis Health UG (haftungsbeschränkt) and are protected by copyright and trademark laws.

8. Disclaimer of Warranties

The Service is provided "as is". While we strive for accuracy, we do not guarantee that the nutritional information provided by our AI is 100% accurate at all times. Use of the information is at your own risk.

9. Limitation of Liability

Under German law, Dynamis Health UG (haftungsbeschränkt) is liable without limitation for damages caused by intent or gross negligence. For simple negligence, liability is limited to the breach of essential contractual obligations (cardinal obligations). In such cases, liability is limited to the typical foreseeable damage.

10. Termination

We reserve the right to suspend or terminate your access to the Service at any time, particularly in cases of misuse or breach of these terms.

11. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany. The place of jurisdiction for all disputes arising from this contract is Munich, provided you are a merchant or have no permanent residence in Germany.

12. Changes to Terms

We reserve the right to modify these Terms. We will notify users of significant changes via the email address associated with their account or through a prominent notice on our website.
